I. General Provisions for Individual and Group Coaching

 

§ 1 Scope and Subject Matter of the Contract

These General Terms and Conditions (GTC) govern the contractual relationships between Dipl.-Psych. Philipp Stahl (hereinafter referred to as “the provider”) and his clients (hereinafter referred to as “the client”).

The subject of the contract is the provision of psychological coaching services in individual or group settings.

The goals of the coaching are individually defined during the initial consultation. A multimodal coaching approach, based on scientifically recognized methods such as behavioral, systemic, and humanistic approaches, is used.

The provider commits to adhering to the ethical guidelines of the German Association of Psychologists (BDP).

The provider acts as a process facilitator and advisor. The client is responsible for their own change work. No specific outcome is guaranteed.

§ 2 Conclusion of Contract and Payment

The contract is concluded by written acceptance of an offer or by payment of the (first) invoice, acknowledging these GTC, the data protection information, and the right of withdrawal.

Payment of the agreed fees must be made in advance and is a prerequisite for participation in the coaching. Participation without payment is excluded.

Unused sessions from a booked package must be utilized within 6 months after the conclusion of the contract, unless otherwise agreed in writing. After this period, unused sessions expire.

§ 3 Right of Withdrawal

For consumers, the statutory right of withdrawal applies. Details and the withdrawal form are provided in the separate withdrawal notice.

§ 4 Scope of Services

Individual coachings and group programs are conducted in person in Berlin or online via a video conferencing platform (e.g., Zoom).

The exact duration and structure of a coaching are defined in the individual offer. Contents may include scientifically based impulses, reflection exercises, and accompanying materials.

§ 5 Appointments and Cancellation Policy

Agreed appointments are binding.

Individual sessions must be canceled at least two working days before the scheduled date. Otherwise, the session is considered used.

Group events (group coachings, workshops) are scheduled over a fixed period. The client’s absence from certain sessions does not entitle them to a refund or credit.

The provider reserves the right to reschedule appointments in case of illness or force majeure. In such cases, a replacement date will be offered.

§ 6 Contract Duration and Termination

The contract ends normally upon achieving the booked coaching goal or upon expiration of the agreed period.

Early termination is possible in cases of:
– significant personal or professional changes,
– health reasons,
– mutual agreement.

In the event of justified termination, a proportional refund for unused services will be made.

Termination must be made in writing.

§ 7 Confidentiality

The provider commits to maintaining confidentiality regarding all private and professional information known within the coaching context.

A waiver of confidentiality can only be made at the client’s express request, in writing.

§ 8 Liability

The provider is liable only for damages resulting from gross negligence or intentional misconduct.

Liability is limited to the paid coaching fees.

The provider is not liable for content or technical issues of external platforms.

§ 9 Data Protection

The data protection provisions according to the privacy policy on www.coachingpsychologe.de apply.

§ 10 Final Provisions

Place of jurisdiction is Berlin.

German law applies.

Any subsidiary agreements must be made in writing.

Should individual provisions of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
